Our Terms of Service


CLUB ENTRY

  • Children must be accompanied by an adult when visiting the club at all times.
  • Any adult bringing children to lessons must be a current club member.
  • Membership cards must be presented at Club Reception.
  • Children entering and leaving the club must be wearing shoes and appropriate clothing - covering swimwear.

CLUB FACILITIES

  • Children must be supervised at all times.
  • Club management reserves the right to refuse entry, cancel membership, or request a student/parent/guardian to leave the premises if that person does not behave in a responsible manner, is under the influence of drugs and or alcohol or does not adhere to the conditions of use.

POOL USE

  • Children are not permitted to use the pool for recreational use outside of swimming lessons.

CHANGE ROOM USE

  • Children are not permitted in the gym change rooms. Gym change rooms are for gym members only.
  • Pool change rooms are available for children.
  • Children over the age of 5 are not permitted in the change rooms of the opposite sex. The Juniors Club has advised that the disabled change rooms are to be used in these circumstances.
  • Showers are to be limited to 3 minutes after classes.

WHAT TO WEAR

  • All children under the age of 3 years are required to wear an approved swimming nappy. Bands around the leg area must be wider than 3cm and not the gathered type.
  • Swimming caps must be worn during lessons
  • Appropriate swimwear must be worn if entering the pool.

MAKE UP POLICY

  • A current enrolment is needed to book a make up.
  • We offer unlimited make up lessons per term.
  • Make up tokens are valid for 3 months.
  • Make up lessons cannot be taken during the first 2 weeks of term.
  • Make up lessons can only be booked up to 7 days in advance.
  • Make up lessons cannot be canceled or altered.
  • Missed private lessons qualify for a make up, but they must be used in a regular class.
  • Make up tokens cannot be transferred between siblings
  • Make up tokens cannot be converted into credits

‘FAST TRACK PROGRESS PACK’ TERMS AND CONDITIONS

  • Fast Track Progress Packs are sold in fixed bundles of 3 tokens.
  • The minimum and maximum purchase per transaction is 3 tokens.
  • The price is fixed and non-negotiable.
  • All purchases are non-refundable and cannot be exchanged for cash, credit, or transferred between siblings.
  • Tokens must be used within 60 days of purchase
  • Bookings must be made via the Parent Portal and are subject to real-time availability.
  • Sessions are offered within existing term schedules; specific days, times, or instructors cannot be guaranteed.
  • Once booked, sessions are final and cannot be rescheduled or cancelled.
  • Fast Track sessions are intended to complement your child’s regular weekly lessons at In The Deep.
  • While consistent participation supports development, progression to the next level is not guaranteed.

ACTIVE KIDS VOUCHERS

  • One voucher can be submitted per student, per term.
  • Valid vouchers will activate a credit onto your account to be applied at time of next term billing.
  • A refund will not be given for a voucher submitted after a payment has been processed.

FIRST AID

Staff of The Deep Swim School are permitted to administer first aid and or organise medical hospital treatment as they see necessary.


PROPERTY

In The Deep Swim School take no responsibility for any loss, damage or theft of any property occasioned by persons as consequence whilst attending lessons with In The Deep Swim School at the Juniors Club.


PHOTOGRAPHY

Photos taken by In The Deep Swim School staff are used for private use only at the swim school which may include marketing, advertising, promotion and staff training purposes.

By accepting our terms of service you are allowing us to use the photos as stated and agree that In The Deep own the images taken.

Parents that don’t agree to any photography need to notify In The Deep in writing.


TEACHER CONTINUATION

  • We cannot guarantee teacher continuation from week to week
  • Teacher continuation cannot be guaranteed term to term
  • We are not always able to provide a male or female teacher on request
  • We do reserve the right to alter instructors mid term if required

REFUNDS

  • In the event of a mid term cancellation, refunds cannot be given for unused fees.
  • In exceptional circumstances when a refund is given, a $30 administration fee will be charged.
  • In The Deep does not provide credit/refunds for any price difference between classes if you choose to move within the term.

SECURITY

How iClassPro ensures your data is secure with us:

  • The iClassPro data center is a fully certified, managed facility with 24x7x365 monitoring and maintenance. Certifications include ISO 27001, PCI Level 1, SAE16, Tier III standards compliant and other local certifications and compliance measures.
  • iClassPro uses redundant systems to ensure access to your data. Intrusion prevention and detection, DDoS protection, bot mitigation and other necessary protections.
  • Your data is mirrored on multiple servers and archival backups are made on a nightly basis to multiple geographic locations.
  • iClassPro has strict access control to all of their application and database servers.
  • An extended validation SSL certificate and https protocol are used for access to all iClassPro application pages - meaning all data is encrypted before being transmitted across the Internet.
  • Each iClassPro account is assigned its own distinct database with its own passwords to prevent data access by other users. Also, any information being sent through the parent portal is encrypted before being transferred across the internet.

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.

I hereby authorise (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.

CLUB POLICIES

The Juniors Club is a registered club and is required by law to operate under the guidelines of the Registered Clubs Act 1976.

CLUB FACILITIES

  • Children must be supervised at all times. The Juniors Club will take no responsibility for any risks of injury in the comings and goings of enrolled students whilst using the club facilities.
  • Club management reserves the right to refuse entry, cancel membership, or request a student/parent/guardian to leave the premises if that person does not behave in a responsible manner, is under the influence of drugs and or alcohol or does not adhere to the conditions of use.

POOL USE

  • Children are not permitted to use the pool for recreational use outside of swimming lessons.

CHANGE ROOM USE

  • Children are not permitted in the gym change rooms. Gym change rooms are for gym members only.
  • Pool change rooms are available for children.
  • Boys over the age of 5 are not permitted in the ladies' change rooms.
  • During afternoon swim lessons mothers are permitted in the male toilet area of the male change rooms to contact sons getting changed in the male change rooms.
